Terms & Conditions
1. Who we are
These Terms govern services supplied by QUANTUM DIGIT MARKETING LIMITED, operating under the Mulberry brand ("Mulberry", "we", "us").
These website Terms provide general information. The proposal, statement of work, or service agreement accepted for a project sets out the binding commercial scope for that engagement.
2. Scope of services
We provide creator marketing, paid media, campaign operations, and related services described in an agreed written scope. Additional services, changes, or new requests may require a separate agreement.
3. Proposals and statements of work
Each proposal or statement of work may specify deliverables, responsibilities, milestones, fees, external costs, assumptions, approval points, and reporting. It becomes binding when accepted in the manner stated in that document.
4. Fees and third-party costs
Our fees, payment schedule, advertising spend, creator compensation, production expenses, software, taxes, and other external costs are addressed in the applicable written scope, including the parties' respective approval and payment responsibilities.
5. Client responsibilities
Clients must provide accurate instructions, lawful and substantiated product claims, required access and assets, and timely approvals. Clients remain responsible for decisions and obligations allocated to them in the written scope.
6. Creators, platforms, and outcomes
Creator availability, platform approval, audience response, reach, sales, and other campaign outcomes are affected by factors outside our sole control and are not guaranteed. Reporting is based on the data available for the agreed channels and period.
7. Intellectual property and usage rights
Ownership and permitted use of briefs, creative work, creator content, media, and project materials are set out in the applicable written scope. No third-party rights are transferred beyond the permissions actually obtained.
8. Cancellation and termination
Cancellation rights, notice, earned fees, reserved resources, and committed third-party costs are governed by the applicable written scope and our Shipping, Service Delivery, Cancellation & Refund Policy.
9. Liability
To the extent permitted by law, neither party is liable for indirect or consequential loss. Any project-specific liability terms are stated in the applicable written agreement. Nothing in these Terms excludes liability that cannot lawfully be excluded.
10. Governing law and contact
Each engagement is governed by the law and forum identified in the applicable written agreement, subject to any mandatory law that applies.
